Who pays the tax on the deed?
Alabama collects a deed recordation tax of 50 cents per $500 of the value conveyed — a dollar per thousand — and the Judge of Probate in the county where the land sits collects it before the deed is recorded (Code of Ala. 1975 §40-22-1). It is a small line item next to a realtor commission, and we cover it.
Can you buy land that is stuck in an estate?
Usually yes. Heir property, unprobated estates and multiple owners are routine for us. What it takes depends on how the estate was handled — sometimes an affidavit, sometimes probate, sometimes signatures from every heir. Do I need a survey or a perc test first?

When do Alabama property taxes go delinquent?
Alabama property taxes are due October 1 and become delinquent January 1. From there the county turns the roll over to Probate Court in February, delinquent parcels are advertised in April and sold at the annual tax sale, usually the first Monday in May, and the owner has three years from the sale to redeem by paying everything owed plus 12% interest. On land nobody lives on, that clock runs unnoticed.
